FCRA Compliance

The Adverse Action Process

If a background report contains findings that may affect your hiring decision, you must follow the FCRA-mandated adverse action process. LABRIX supports you through every step.

Pre-Adverse Action Notice

LABRIX allows you to send a pre-adverse action notice to the candidate. This gives them a copy of their report and a reasonable timeframe — typically 7 days by default — to review the findings.

Waiting Period

After sending the pre-adverse notice, you must wait a reasonable period — the default 7 days — before making a final decision. This gives the candidate adequate time to respond to any findings.

Final Adverse Action Notice

If you still decide not to move forward with the candidate after the waiting period, LABRIX enables you to send the final adverse action notice as required by the FCRA.
